I, the undersigned, understand that yoga, in person, or by video instruction includes physical movements as well as an opportunity for relaxation, stress re-education and relief of muscular tension. As is the case with any physical activity, the risk of injury, even serious or disabling, is always present and cannot be entirely eliminated. If I experience any pain or discomfort, I will listen to my body, discontinue the activity, and ask for support from the instructor. I will continue to breathe smoothly. I assume full responsibility for any and all damages, which may incur through participation. *

I, the undersigned, am aware that there are significant risks involved in physical training, including but not limited to, the physical training inherent to all yoga exercise activities, and that my participation in any such physical training program carries with it the potential for death, injury, and/or property damage. The risks include, but are not limited to, falls which can result in serious injury or death; injury or death due to negligence on the part of myself, my training partner, or other people around me; injury or death due to improper use or failure of equipment; strains and sprains; those risks caused by terrain, facilities, temperature, weather, condition of athletes, equipment, vehicular traffic, actions of other people including, but not limited to, participants, volunteers, spectators, coaches, and trainers and lack of hydration. These risks are not only inherent to physical training and athletics, but are also present for volunteers and spectators. I am aware that any of these above mentioned risks may result in serious injury or death to myself and or my partner(s). I willingly assume full responsibility for the risks that I am exposing myself to and accept full responsibility for any injury or death that may result from participating, volunteering or watching in any physical training, including this yoga program. I realize that liability may arise from negligence or carelessness by the persons or entities being released, from dangerous or defective equipment or property owned, maintained or controlled by them or because of their possible liability without fault. I acknowledge that I have no physical impairments, injuries, or illnesses that will endanger me or others. *

Yoga is not a substitute for medical attention, examination, diagnosis or treatment. Yoga is not recommended and is not safe under certain medical conditions. By signing, I affirm that a licensed physician has verified my good health and physical condition to participate in such a fitness program. In addition, I will make the instructor aware of any medical conditions or physical limitations before class. If I am pregnant, become pregnant or I am post-natal or post-surgical, my signature verifies that I have my physician's approval to participate. I also affirm that I alone am responsible to decide whether to practice yoga and participation is at my own risk. In consideration of my participation in these yoga classes, I understand and voluntarily accept this risk and agree that Kimberly Schulz doing business as Kimberly Kincses Schulz, her employees, agents, heirs and assigns will not be liable for any injury, including without limitation, personal, bodily, mental injury, economic loss or damages to me, my spouse, or unborn child or relatives resulting from the negligence of Kimberly Schulz or anyone acting on her behalf. I hereby agree to irrevocably release and waive any claims that I have now or may have hereafter against Kimberly Schulz and her agents, heirs and assigns. *

Further, I understand and acknowledge that Kimberly Schulz does not manufacture fitness or other equipment that may be used in these yoga classes and/or workshops, but purchases and/or leases all such equipment. I understand and acknowledge that Kimberly Schulz is providing instructional and recreational services and may not be held liable for any injury caused by defective products. *

I, the undersigned, understand that Kimberly Schulz may use products that include latex, and or oils and it is my duty to notify Kimberly Schulz of any allergies prior to the session, and perform my own due diligence prior to participating in class or using any equipment or oils. *

I, the undersigned, understand that Yoga may require a certain amount of physical contact between Instructor and Client to ensure proper technique. It is my responsibility to address any discomfort relating to their practice, in person or by video, or the Instructor’s contact. *

No warranties or representations have been made to me about the Activity which are not stated on this form. I understand and intend that this document act as the broadest and most inclusive assumption of risk, waiver, release of liability, agreement not to sue and indemnity. *

If any provision of this agreement shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. *
